Draft Act amending certain acts in connection with the adoption of the Act limiting the environmental impact of selected plastic products

The proposed Act stipulates rights and obligations for a range of selected plastic products, primarily single-use plastic products that are not manufactured, designed or placed on the market in a manner that allows them to be re-used during their life cycle or to go through several cycles by being returned to the producer to be refilled or re-used for the same purpose for which they were intended. The plastic products for which the proposed Act

stipulates new rules for limiting their environmental impact are plastic packaging products (food containers, cups for beverages, etc.).
- In accordance with Articles 6 and 7 of Directive (EU) 2019/904, the proposed Act stipulates that plastic beverage containers with a capacity of up to three litres that have caps and lids made of plastic can be placed on the market only if the caps and lids remain attached to the containers during the product’s intended use stage; from 2025, beverage bottles with a capacity of up to three litres which are manufactured from PET as the major component (PET bottles) contain at least 25 % recycled plastic, and from 2030, all plastic beverage
bottles with a capacity of up to three litres contain at least 30 % recycled plastic.
- In accordance with Article 8 of Directive (EU) 2019/904, the draft Act requires the introduction of extended producer responsibility schemes for certain types of plastic packaging (packaging materials).
- In accordance with Article 10 of Directive (EU) 2019/904, the draft Act stipulates that a producer of specified plastic products (e.g. food and beverage containers) must, as part of awareness raising measures, inform consumers of the established facts.
- In accordance with Article 4 of Directive (EU) 2019/904, the draft Act also stipulates measures to reduce the consumption of cups for beverages and food containers for immediate consumption.
- In accordance with Article 9 of Directive (EU) 2019/904, the draft Act sets goals for ensuring separate collection of plastic beverage bottles with a capacity of up to three litres for the purposes of recycling.
