Requirements for measuring instruments used to test the breath exhaled by a person

The draft Cabinet Regulation, ‘Requirements for measuring instruments used to test the breath exhaled by a person’ stipulates that the measuring instrument is a stationary, mobile, portable measuring device which determines the alcohol mass concentration in exhaled breath within the specified error limits, and which is intended to obtain evidence/confirmation for the application of the requirements of the law.

At the same time, the draft defines the metrological and technical requirements for the breathalyser, the operating conditions of the breathalyser, requirements for the marking of the breathalyser and its software identification. The breathalyser is to be accompanied by instructions for use in the official language, containing information on the principle of operation of the breathalyser, correct use, as well as maintenance and permissible settings thereof.

With the entry into force of the Regulation, type-approval certificates for breathalysers issued before the date of entry into force of the regulations are to be valid until the expiry of the term specified therein.
