This draft Regulation lays down the conditions and procedures for:

1. the direct supply, by the producer, to the final consumer or to local retail establishments directly supplying the final consumer, of small quantities of:
(a) primary products - raw milk; honey; hen, turkey, goose, duck, guinea fowl, pheasant, partridge, quail and ostrich eggs; fresh and chilled marine and freshwater fish;
(b) fresh meat from poultry, rabbits and ostriches slaughtered on the farm;
(c) shot large and small wild game or meat from large and small wild game;
2. the supply of food of animal origin, handled and/or processed in a retail establishment, to other retail establishments as a marginal, localised and restricted activity.

Draft Regulation on the requirements for the direct supply, by the producer, of small quantities of primary products and food of animal origin.

The Regulation determines national measures in accordance with Article 1(4) and (5) of Regulation (EC) No 853/2004 of the European Parliament and of the Council of 29 April 2004 laying down specific hygiene rules for food of animal origin (OJ L 139 of 30.4.2004) (Regulation (EC) No 853/2004).

The Regulation is issued on the basis of Article 7(1) of the Food Act and repeals Regulation No 26 of 2010 on the specific requirements for the direct supply of small quantities of raw materials and food of animal origin (State Gazette (SG) No 84 of 2010).
The Regulation lays down the conditions and the procedures for:
1. the direct supply, by the producer, to the final consumer or to local retail establishments directly supplying the final consumer, of small quantities of:
(a) primary products - raw milk; honey; hen, turkey, goose, duck, guinea fowl, pheasant, partridge, quail and ostrich eggs; fresh and chilled marine and freshwater fish;
(b) fresh meat from poultry, rabbits and ostriches slaughtered on the farm;
(c) shot large and small wild game or meat from large and small wild game;
2. the supply of food of animal origin, handled and/or processed in a retail establishment, to other retail establishments as a marginal, localised and restricted activity.
The quantities of primary products, the number of poultry and rabbits slaughtered on the farm, and the large and small wild game shot, defined as ‘small quantities’ for direct supply, are set out.
The draft Regulation sets out the requirements for establishments where slaughtering/harvesting/catching of primary products is carried out, the requirements for the products themselves, and the requirements for carrying out the direct supply of such products to the final consumer.
The conditions for the supply of food of animal origin, handled and/or processed in a retail establishment, to other retail establishments as a marginal, localised and restricted activity in the meaning of Article 1(5)(b)(ii) of Regulation (EC) No 853/2004 have been set out. The terms ‘marginal activity’, ‘localised activity’ and ‘restricted activity’ have been defined.
The draft provides for the handling and/or processing of food of animal origin to be carried out in establishments which have been approved in accordance with Article 40 of the Food Act and entered in the register under Article 24(1), in accordance with Article 41 of the Food Act. Specific requirements for both the establishments and the processes of handling and/or processing raw milk and meat in retail establishments, to other retail establishments as a marginal, localised and restricted activity within the meaning of Article (1)(5)(b)(ii) of Regulation (EC) No 853/2004 have been set out.
The direct supply of small quantities of primary products and supply of food of animal origin from retail establishments to other retail establishments as a marginal, localised and restricted activity is to be carried out in compliance with the requirements laid down in Articles 37-42 of the Food Act.
