Order of the Minister for Agriculture, Nature and Food Quality amending the Agricultural Quality Regulation 2007 for the preventive control of the tomato virus ToBRFV in organic cultivation

Having regard to Commission Implementing Decision (EU) 2019/1615 of 26 September 2019 establishing emergency measures to prevent the introduction into and the spread within the Union of Tomato brown rugose fruit virus (ToBRFV) (OJ L 250, 2019), and that, by virtue of Commission Regulation (EC) No 889/2008 of 5 September 2008 laying down detailed rules for the implementation of Council Regulation (EC) No 834/2007 on organic production and labelling of organic products (OJ L 250, 2008), no Community exhaustive list of products that may be used for cleaning and disinfecting organic plant production buildings and installations has been established, use is made of the national leeway provided for in Article 95(6) of the latter regulation.

Member States may authorise the use of certain products at the national level provided that this is in conformity with the objectives, principles and criteria of the European legislation on organic production. The Netherlands has cautiously entered the potential applications in Annex III to the Agricultural Quality Regulation 2007.
Annex III does not yet contain products suitable for combating the tomato virus ToBRFV. Products containing the substances benzoic acid or pentapotassium bis(peroxymonosulphate) bis(sulphate) are listed, however. The proposed amendment of Annex III to the Agricultural Quality Regulation 2007, with regard to Article 8a of that Regulation, authorises the use of the substances benzoic acid and pentapotassium bis(peroxymonosulphate) bis(sulphate) for preventive cleaning and disinfection in the organic cultivation of tomatoes, sweet peppers and
chilli peppers in the Netherlands.
