Draft Decree amending Decree No 133/2010 on fuel requirements, on fuel composition and quality supervising and monitoring, and registration of them (Fuel Quality and Registration Decree), as amended.

The draft Decree amending Decree No 133/2010 on fuel requirements, on fuel composition and quality supervising and monitoring, and registration of them (Fuel Quality and Registration Decree), as amended is necessary to fulfil the enabling provision of § 11 of Act No 311/2006 on fuels and service stations and amending some related acts (the Fuels Act), as amended, due to the amendment to this Act by Act No 48/2020. This amendment to the Act was primarily elicited by the need to modify the definition of a fuel distributor and the need to refine the definition and records of fuel dispensing as well as the need to clarify conditions for records concerning charging stations for electric vehicles. An annex was added to the draft Decree that regulates the manner in which data on the amount of electricity consumed to charge vehicles at charging stations is transmitted. In the past period, fossil and alternative fuels have exhibited formal and informal changes in technical requirements in the sense of changes in the definition of terms and relevant technical standards, which the Decree makes mandatory. Definitions of new alternative fuels were added to the draft Decree, and existing definitions were clarified, especially for biogas, biomethane, synthetic fuel, high FAME diesel fuel and other primarily renewable resource-based fuels. The subject of the submitted amendment to the Fuel Quality and Registration Decree is an update of the definitions in the sense of the definition of individual types of fuels through the Combined Nomenclature codes set out in Council Regulation No 2658/87 on the tariff and statistical nomenclature and on the Common Customs Tariff, as amended on 1 January 2020.
