Ornamental plants liable to be harmful to human health

Order on prior information to be provided to purchasers of plants liable to be harmful to human health

The draft Order is issued pursuant to Article L1338-3 of the Public Health Code. It determines:

- the list of plants liable to be harmful to human health (risk of intoxication by ingestion, risk of respiratory allergy, risk of mucocutaneous reaction, risk of abnormal cutaneous reaction in case of exposure to the sun);
- information on the health risks associated with these plants and on the means of protecting against them which is to be the subject of the information provided to the purchaser prior to the sale by the seller or the distributor;
- the procedures for delivering this information (informative materials, dissemination methods, etc.) according to the type of sale (retail, distance selling, public procurement).

Forest reproductive material, plants sold for consumption, cut flowers, foliage branches, cut trees retaining foliage, plant tissue cultures and grass seed mixtures are excluded from the provisions of this Order.
