Order regulating air pollution from solid fuel combustion plants under 1 MW

Just a few points in the Order regulating air pollution from solid fuel combustion plants under 1 MW (The Wood-Burning Stove Order - referring to No 1461 of 7 December 2015) are to be amended, while individual provisions are to be deleted as they no longer apply. The most important of these is that current Danish limit values and certification requirements for certain solid fuel boilers are ceasing and being replaced by new EU regulations as a result of ecodesign requirements for solid fuel boilers. The new regulations for certain solid fuel boilers are implemented in Commission Regulation (EU) 2015/1189 (the Solid Fuel Boiler Regulation).

Under Article 288 of the Treaty on the Functioning of the European Union, a Regulation applies immediately in every Member State. The new regulation was published in 2015. The regulation enters into force on 1 January 2020.

Solid fuel boilers (central heating boilers) with a nominal heat input exceeding 500 kW and less than 1 MW are still regulated by the Wood Stove Order.

As a result of the Sold Fuel Boiler Regulation, a new § 4(5) has been introduced, which refers to solid fuel boilers not exceeding 500 kW placed on the market or commissioned on or after 1 January 2000 only being able to be used where it is established through a conformity assessment that all relevant requirements in the Solid Fuel Boiler Regulation are complied with.

At the same time, a new § 7(3) has been introduced, dealing with conformity assessment controls performed by chimney sweeps when commissioning solid fuel boilers not exceeding 500 kW, cf., the requirements regarding conformity assessments in the Solid Fuel Boiler Regulation.

In the Wood-Burning Stove Order, the limit values applying to solid fuel boilers covered by the Regulation are reproduced in a table summarised from the Solid Fuel Boiler Regulation, Annex II(1).
