Prohibition of the placing on the market of plant protection products containing the active substance glyphosate

Federal Act amending the 2011 Plant Protection Products Act

§ 18(10) of the 2011 Plant Protection Products Act should read as follows:

‘The placing on the market of plant protection products containing the active substance glyphosate is prohibited in accordance with the precautionary principle.’

For the entry into force of the above provision, the following conditions have been agreed:

The following paragraph 5 is added to § 17:

‘5. § 18(10), as amended by the Act published in Federal Law Gazette I No XX/2019, shall only enter into force on the condition that:

1. this provision has been notified in accordance with the provisions of Directive (EU) 2015/1535 laying down a procedure for the provision of information in the field of technical regulations and of rules on Information Society services, OJ L 241, 17.9.2015, p. 1;

2. the three-month standstill period to be observed in accordance with Article 6(1) of this Directive has expired; and

3. a detailed opinion has not been delivered in accordance with Article 6(2) of this Directive and no announcement by the European Commission has been made within the three-month standstill period in accordance with Article 6(3) or (4) of this Directive.

The Federal Chancellor shall announce the entry of the aforementioned condition in the Federal Law Gazette. On fulfilment of the condition, § 18(10), as amended by the Act published in Federal Law Gazette I No XX/2019, shall enter into force on 1 January 2020.’
