The Building Regulations provide for the health, safety, welfare and convenience of those in and around buildings and the sustainability of buildings for current and future generations. In order to do this they set standards through both technical and procedural requirements for those carrying out building work. Therefore this notification has relevance for services including design and construction services for controlled building works and related construction products.

The draft measure set out in this application relates to action taken, in response to the application of building regulations, to address the risk from fire to occupants of the building and to the fire and rescue service.

Building Regulations (Amendment) (Wales) Regulations 2019 and amendments to guidance in Approved Document B and Approved Document 7 to ban the Use of Combustible Materials in high rise residential buildings in order to address fire safety.

The Building Regulations 2010 provide for the health, safety, welfare and convenience of those in and around buildings, setting technical and procedural requirements for those carrying out building work. Statutory guidance on ways of meeting the functional requirements of these regulations are provided in Approved Documents.

The proposed changes to the Building Regulations will prohibit the use of combustible materials (materials which do not meet A1, or A2 of BS EN 13501-1) within the external walls, and certain attachments to the external walls, of any building with a storey at least 18 metres in height where: -

i. The building contains at least one dwelling;-

ii. The building contains certain residential accommodation for the treatment, care or maintenance of persons;-

iii. The building contains certain rooms used for residential purposes, including care homes, student accommodation and school dormitories

The amendments to Approved Document B (Fire Safety) clarify the application of the amended regulations.
