Plastic beverage bottles of three litres or less

Plastic bottles for water and soft drinks of three litres or less

Decree of [date to be inserted] amending the 2014 Packaging Management Decree regarding the inclusion of a target for the separate collection of plastic beverage bottles and amendments to the provisions on deposits for beverage packaging (Decree on measures for plastic beverage bottles)

The draft measure requires:

1. A producer or importer who places beverages in plastic bottles with a volume of 3 litres or less on the market in the Netherlands to collect separately in each calendar year at least 90 percent by weight of the total amount of these bottles, including caps and lids, placed on the market in the Netherlands by the producer or importer in that calendar year (Article I(b));

2. A producer or importer who places water or soft drinks in plastic bottles with a volume of 3 litres or less on the market in the Netherlands to charge deposits on such bottles and to accept returns of such bottles after use with repayment of the deposit. (Article I(F)). This deposits provision reduces the scope of the previously notified deposits provision (Article 12 of Notification No 2014/0336/NL) from all types of beverage packaging to only plastic bottles for water and soft drinks.

A mutual recognition clause is not needed as the requirements of the draft measure do not cause foreign products to be denied market access.
