Online gambling operators

Order reforming the regulation of gambling

The draft Order is issued pursuant to IV of Article 137 of Law No 2019-486 of 22 May 2019 on business growth and transformation. In particular, this Article empowers the Government to take, by way of an order, any measure falling within the scope of the law whose purpose is to redefine and specify the regulatory arrangements of this sector, with a view to establishing an independent administrative authority.

These regulatory arrangements include the control of rules relating to information society services incumbent on gambling and sports betting operators offering online services.

There are two types of technical rules within the draft Order. Firstly, they aim to regulate the commercial communications of operators (see draft Articles L320-10 and L320-13 of the Internal Security Code) and their promotional policies (see XIV of Article 12 of the draft Order).

Secondly, the technical rules included in the draft Order specify all the obligations imposed on the operators with regard to producing documents (see XIV of Article 12 of the draft Order) and making data available to public authorities (see XVIII of Article 12 of the draft Order).
