Draft Act amending the Burgenland Genetic Engineering Precautionary Measures Act

Within the framework of the stipulations under Article 26b(3) and (4) of Directive (EU) 2015/412, this amendment is intended to create the possibility to restrict or prohibit the cultivation of GMOs in a given case on certain public interest grounds. Through the new § 6a, the Provincial Government is to receive the possibility to prohibit, by means of an ordinance, the cultivation of GMOs across the entire provincial territory or parts thereof. The notification obligation in the new § 6b is in line with Directive (EU) 2015/412. In addition, amendments were made in line with Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation – GDPR).
