Installations and facilities for:

- the mixing of waste

- the indoor storage of gas oil, lubricating oil and waste oil

- the delivery of liquid fuel or compressed gas other than to road motor vehicles, vessels or railway vehicles

- the storage of packaged hazardous substances

Decree amending the Environmental Management (Activities) Decree [Activiteiten milieubeheer] and the Environmental Law Decree [Besluit omgevingsrecht] in connection with necessary periodic maintenance and the correction of certain subordinate substantive defects.

Article I, Parts D, E, J and S, and Article II, Part B(4) and (7) may contain technical regulations. The Environmental Management (Activities) Decree contains general rules for companies relating to the environment. The Environmental Law Decree specifies when companies fall under the general rules of the Environmental Management (Activities) Decree and when a permit is required. The draft Decree amending the Environmental Management (Activities) Decree and the Environmental Law Decree applies certain amendments to the definitions of activities that fall under the general rules or under a permit requirement when relating to the environment. These amendments to the definitions could lead to existing regulations relating to the environment being applied to some new companies. The new regulations that will apply serve to meet relevant and recognisable environmental objectives and are based on recent and generally accepted environmental findings. The regulations are easy to implement and enforce. Moreover, some amendments have been made to the regulations in the Environmental Management (Activities) Decree and the Environmental Law Decree. Said amendments do not contain any new technical regulations.

Mutual recognition is not applicable. This does not involve goods, but rather general product-related regulations. Where the amending Decree does refer to goods, declarations of verification or professional requirements, the mutual recognition clause in Article 1.3 of the Environmental Management (Activities) Decree shall apply.
