Commission Regulation (EC) No. 1333/2008 of the European Parliament and of the Council of 16 December 2008 regarding food additives was adopted in Israel as part of Amendment No. 10 to the Public Health Protection (Food) Law, 5776-2015 (hereinafter - the Law/Food Law), and appears in Item 8 of Appendix II A to the Law. Regulation 1333/2008 was applied in full, in addition to the exceptions as stated in Section 3A(a1) to (a5) of the Law.

To date, notices have been published in the Official Gazette (Reshumot) that included changes that took place in the European Union in Regulation 1333/2008, and which were applied in Israel (updates), with the most recent being published on 24 December 2025, being the Public Health Protection (Food) Notice (Application of Changes in the Annex to the European Union Directives) (Regulation 1333/2008 - Food Additives) (No. 2)(Amendment), 5776-2025, signed by the director of Health Regulation Directorate (Food, Alcoholic Beverages and Cosmetics) at the Ministry of Health. The latest updated consolidated version, adopted and published on the Food Service website following the publication of the aforementioned notice, is the version valid in European legislation as as it stood on 31 July 2025.

It is now proposed to apply in Israel the change in the Annex to Regulation 1333/2008 that applied in the European Union, without modifications, conditions, exceptions, or expansions, while integrating them into the text of Regulation 1333/2008, as adopted today. The essence of the change is a change in the conditions of use of various food additives.

The changes included in this proposed amendment combine the following EU Regulations amending various Annexes of Regulation (EC) No. 1333/2008, after Item No. 8:

·        Item 9: Commission Regulation (EU) 2025/2058 of 14 October 2025 amending Annexes II and III correcting Annex II to Regulation (EC) No. 1333/2008 of the to European Parliament and of the Council as regards foods intended for particular uses:

1.    In Annex II -

(a) Part A - (1) Table 1, replace entry 12; (2) Table 2, replace entry 30;

(b) Part D - (1) Add entry 01.10; (2) Replace the entry regarding Category 13 and its subcategories; (3) Replace the entry regarding Category 18;

(c) Part E - (1) Replace the entry regarding Category 0, 290, E942, E941, E939, E938, E949, E948, E949; (2) Add entry regarding Edible caseinates; (3) Replace citation 06.4.2 (Dry pasta); (4) Replace heading of Category 13; (5) Replace citation 13.1 (Food for infants and young children); (6) Replace heading of Category 13.1.1; (7) Replace footnote (15) to Categories 13.1.1 and 13.12; (8) Replace footnote (43) to Categories 13.1.1 and 13.12; (9) Replace footnote (44) to Categories 13.1.1 and 13.12; (10) Replace heading of Category 13.1.2; (11) Replace heading of Category 13.1.3; (12) Delete citation of Category 13.1.4; (13) Replace heading of Category 13.1.5; (14) Change of heading of Category 13.1.5.1; (15) Change of heading of Category 13.1.5.2; (16) Change the heading of Category 13.2; (17) Change the heading of Category 13.3; (18) Delete a citation of Category 13.4; (19) Change the citation of Category 18 and add two new citations regarding Categories 18.1, 18.3.

2.    In Annex III -

(a) replace the definition in paragraph 1 of 'Nutritional components';

(b) in Part 5 - (1) Part A, replace the introductory wording; (2) Part B, replace the introductory wording; (3) Part B, replace the table.

3.    In Annex II, Part E -

(a) replace the entry in Category 13.2 regarding the value Advantame;

(b) replace the entry in Category 13.3 regarding the value Advantame.

·        Item 10: Commission Regulation (EU) 2025/2060 of 14 October 2025 amending Regulation (EC) No. 1333/2008 of the to European Parliament and of the Council as regards the use of sorbic acid (E 200) and potassium sorbate (E 202) in non-heat-treated plant-based mousses:

1.    In Annex II, Part E -

Additional reference is made to food category 16, regarding Potassium-acid Sorbic sorbate E 200-202.

·        Item 11: Commission Regulation (EU) 2025/2084 of 17 October 2025 amending Regulation (EC) No. 1333/2008 of the European Parliament and of the Council as regards the specifications for quillaia extract (E 999):

1.    In Annex II, Part E -

(a) replacing the reference of Category 14.1.4 concerning 999E, Quillaia extract;

(b) replacing the reference of Category 14.2.3 concerning 999E, Quillaia extract;(c) Add a reference in category;

(c) Add a reference in category 17.1 in respect of 999E, extract of Quillaia after the second entry in respect of E 969;

(d) Add a reference in category 17.2 in respect of 999E, extract of Quillaia after the second entry in respect of E 969.

2.    In Annex III, Part 4 - Add a reference in respect of E 999, extract of Quillaia, after the entry in respect of Beeswax E 901.
