Biocidal products and treated articles treated with or incorporating biocidal products

Draft Commission Implementing Decision not approving chloramin B as an active substance for use in biocidal products of product-types 2, 3, 4 and 5 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council

This draft Commission Implementing Decision does not approve chloramin B as an active substance for use in biocidal products of product-types 2, 3, 4 and 5.

This active substance is no longer supported by the applicant, who submitted its applications for approval under the previous Directive 98/8/EC outside the review programme of existing active substances, and the conditions for approval under the Biocidal Products Regulation (EU) No 528/2012 are thus not met. 

Biocidal products containing this active substance already cannot be placed on the market, but treated articles with those biocidal products are benefitting from the transitional provisions set out in Article 94 of the Biocidal Products Regulation (EU) No 528/2012, because the applications for approval were submitted before 1st September 2016. In order to ensure that those treated articles are no longer placed on the EU market, it is necessary to adopt a non-approval decision.
