Tanning devices and services using these devices

Draft decree amending Decree No 2013-1261 of 27 December 2013 on the sale and public availability of certain tanning devices which use artificial ultraviolet radiation

This draft decree, issued pursuant to Article 21 of Law No. 2016-41 of 26 January 2016 on the modernisation of our healthcare system, sets out several provisions relating to technical standards:

- clarify the definition of tanning devices covered by the prohibition laid down by law (sale or transfer, including free of charge, of a tanning device for non-professional use) and the scope of the law;
- strengthen the procedures for informing the public about the health risks associated with artificial tanning, and clarify the procedures for certifying that this information has been provided, as well as the procedures for the registration and inspection of such devices;
- introduce additional penalties against business operators and professionals who offer services involving the use of a tanning device, accredited inspection bodies and training organisations that breach the regulations (failure to comply with regulatory obligations regarding the training of professionals, failure to comply with provisions on public information, failure to comply with obligations regarding the maintenance and technical inspection of devices, etc.)
