Draft Emergency Ordinance on the introduction in Romania of used, repaired, or reconditioned products, as well as the withdrawal from the market of products identified as hazardous

The draft proposes a series of significant changes regarding the import of textile products, footwear, toys, furniture, low-voltage electrical equipment, vehicles, and tires into Romania, particularly those that are secondhand, reconditioned, or withdrawn from the market due to safety concerns. The main purpose of these measures is to protect public health and improve the safety of products available on the market.

The draft legislative act lays down additional requirements for the economic operators, so that it is necessary, prior to placing on the market, marketing, and free distribution, even as a donation of products and/or categories of products withdrawn from the market as hazardous, to ensure that they are subjected to cleaning, disinfection, and pest control measures to ensure their safe marketing.
All of the products mentioned shall be marketed only if they comply with safety standards and are accompanied by the appropriate documentation. Products considered hazardous shall be withdrawn from the market and treated as waste, in accordance with environmental legislation.
An important aspect of the legislative act is the ban of placing on the market used vehicles that have been declared a total loss, decommissioned, or unregistered in their country of origin, in order to prevent risks to consumer safety.
The draft also introduces a significant digital component through the development of the SIATD RO-SH platform, an integrated system designed to manage and track the relevant products. This platform will enable more effective tracking of the product supply chain and will help increase market transparency
