Draft decree implementing Article L.1513-3 of the Transport Code

The draft decree specifies the conditions for the implementation of Article L.1513-3 of the Transport Code. It inserts Articles R.1513-12 to R.1513-16 into the Transport Code. It specifies that the declaration of conformity required of data holders and users is that referred to in Article 8 of Delegated Regulation (EU) No 885/2013, Article 9 of Delegated Regulation (EU) No 886/2013 and Article 12 of Delegated Regulation (EU) 2022/670. It determines the time limits within which supporting documents must be provided to the Transport Regulation Authority (ART). It also specifies the scope of the supervisory powers held by the ART and designates the ART as the national competent authority for assessing compliance with the requirements laid down in Delegated Regulations (EU) No 885/2013, No 886/2013 and No 2022/670.

Lastly, it provides that an order of the Minister responsible for transport will specify the format of the description of the data or information services, the information on quality and the conditions for the re-use of the data, as well as the format and content of the declaration of conformity
