Draft decree implementing Article L.1115-5 of the Transport Code

The draft decree is issued pursuant to the aforementioned Article L.1115-5. It amends Articles R.1115-5 to R.1115-8 of the Transport Code by providing several clarifications concerning the powers of the Transport Regulatory Authority [l'Autorité de régulation des transports] (ART) and its audit tools, in particular the declaration of conformity.

The draft decree confirms that the declaration of conformity mentioned in Article L.1115-5 of the Transport Code corresponds to that mentioned in Article 9, Section 2, of Commission Delegated Regulation (EU) 2017/1926, of 31 May 2017.
It specifies that the obligation to provide data via the intermodal transport national access point [point d'accès national] (PAN) covers static, historical and observed data relating to travel and traffic in accordance with Article 4, Section 1, of the amended delegated regulation and dynamic data in accordance with its Article 5, Section 1.
It opens up the possibility for the Transport Regulatory Authority (ART) to receive reports from third parties, including approved consumer associations, in order to carry out verifications on the accuracy of declarations of conformity
