ROYAL DECREE AMENDING ROYAL DECREE 760/2021 OF 31 AUGUST 2021 APPROVING THE QUALITY STANDARD FOR OLIVE AND OLIVE POMACE OILS
This royal decree modifies Royal Decree 760/2021 of 31 August 2021 approving the standard for the quality of olive oil and olive pomace oil.
Firstly, it incorporates a new definition of ‘final recipient of the goods’, in order to resolve the problems detected in the management of imports from third countries. The new definition will make it possible to identify the responsible operator more clearly and thus improve the traceability of these movements.
Secondly, it introduces the obligation to notify the system once the movement of olive oil has been completed.
Administrative practice has shown that, in the absence of such confirmation, numerous transactions remain open in the system without any record of their actual delivery, which makes it difficult for the competent authorities to monitor them and reduces the reliability of the recorded information.
Thirdly, it reinforces the documentary system established in Royal Decree 760/2021 in relation to the transport of olive and olive pomace oils in bulk. Although Royal Decree 760/2021 of 31 August 2021 already imposed an obligation to accompany these movements with an analysis bulletin or similar document, this amendment adds the requirement to incorporate those documents in the computerised system at the time of notification. In addition, where the operator provides an equivalent document instead of the bulletin, this fact may be assessed by the competent authorities as a criterion in their risk analysis, especially when drawing up control plans
