Batteries and waste batteries

Accompanying Act to the EU Battery Regulation – BattBegG

As required by Regulation (EU) 2023/1542 concerning batteries and waste batteries, the draft includes the designation of competent authorities and the establishment of penalties for violations. Furthermore, the legislation provides for mandatory participation in a collection and recycling scheme for the relevant battery categories, as well as provisions regarding market surveillance. In addition, the existing legal framework is being brought into line with the EU Regulation (in particular with regard to definitions).

At the same time, the existing, well-functioning structures – in particular such as the collection and recycling systems for waste batteries, separate collection in the municipal sector for waste portable batteries in particular, and the collection coordination system proven by the Waste Electrical and Electronic Equipment Coordination Office (which ensures a market-driven distribution of collected waste batteries across the collection and recovery systems) are largely to be retained in accordance with Regulation (EU) 2023/1542
