Proposal for a Decree of the Ministry of the Environment amending the Decree of the Ministry of the Environment on the climate reports of buildings and the list of construction products

This amendment to the Decree proposes to amend the Decree of the Ministry of the Environment on the climate reports of buildings and the list of construction products to comply with the requirements of the Energy Performance of Buildings Directive and the delegated act adopted thereunder. The main amendment relates to the addition of new life cycle stages so as to include in the calculation of the carbon footprint the use of construction products (B1), building maintenance (B2) and building renovation (B3). In addition, the use of construction products as energy after the end of the life cycle of the building would be added to the carbon handprint. This amendment to the Decree also proposes adding products and components related to building systems, such as building automation and IT systems, as well as security systems, to the scope of the assessment. With regard to the data used in low carbon assessments, it is proposed that the Decree be amended to establish a hierarchy for the source data. In terms of reporting results, this amendment to the Decree proposes that the results should be reported in kgCO2e/m² instead of kgCO2e/m²/a as currently reported. It is proposed that the Decree be amended to specify how reporting should be carried out in specific situations. Provisions regarding permitted exceedances of limit values due to exceptional circumstances are laid down in the Government Decree on limit values for the carbon footprint of new buildings (2/2026).
