Dänemark Gambling
Act amending the Danish Gambling Act and the Danish Corporation Tax Act
Tightening of the scope and content of gambling advertisements:
- Prohibition of advertising of gambling on television and streaming in connection with live sports broadcasts.
- Prohibition of gambling advertising at a distance of 200 metres from schools and youth educational establishments and during and in connection with public transport.
- Content restrictions on marketing material, including a ban on the use of authorities, persons under the age of 25, and content that specifically appeals to children and young people.
- Tighter rules for marketing on social media and for affiliates.
Strengthening the Danish Gambling Authority's supervisory powers:
- Expansion of the scope of marketing activities for unlicensed games that can be sanctioned.
- Introduce provisions to block illegal marketing of games that are not authorised under the Gambling Act.
- Better opportunities to impose sanctions for violations of the Gambling Act. There are clearer principles and criteria for calculating fines, and the Danish Gambling Authority's authority to issue administrative fines is clarified.
Modernisation of land-based gambling:
- Dealer authorisation replaces manager authorisation.
- The rules on where games may be offered are simplified. Specifically, it does so by removing the term ‘gaming shop’ and, at the same time, interpreting the term ‘gaming hall’ in such a way as to combine the two sets of rules in force.
Additional games are covered by the definition of games for land-based casinos and online casinos in order to ensure that the games are subject to gaming regulations, enabling the Danish Gambling Authority to supervise the gaming market more effectively.
A provision is inserted regarding the duty of care and action for gaming providers, which means that gaming providers must keep a closer eye on their players.
As part of the financing of the agreement, the surcharge is reduced to the credit rate for the excess tax paid by companies. The supplement of 0.75 percentage points is reduced to 0.2 percentage points
