Second Act on the Further Development of the Greenhouse Gas Reduction Quota

This Act updates the Greenhouse Gas Reduction Quota (GHG quota). The following measures are taken for this purpose:

- The mandatory percentage reduction of greenhouse gas emissions from fuels is extended until 2040 and will gradually increase to 59%. This corresponds to a share of renewable energy in total energy consumption of 62% according to the RED III calculation method.
- A general quota for renewable fuels of non-biogenic origin is introduced across the scope of the GHG quota.
- The quota for advanced biofuels (from feedstocks listed in Annex IX, Part A of Directive (EU) 2018/2001) is increased, and double counting is eliminated.
- Renewable fuels will only be eligible for credit towards the GHG quota if on-site inspections by government inspectors are possible.
- The crediting of biofuels made from palm oil production residues towards the GHG quota will be discontinued.
Further amendments to the Federal Immission Control Act (BImSchG) serve to implement Regulation (EU) 2023/2405 (ReFuelEU Aviation). In particular, the competent authorities responsible for enforcing the regulation in Germany are defined. Furthermore, sanctions for violations of Regulation (EU) 2023/2405 are stipulated in the BImSchG. The scope of the Biofuel Sustainability Ordinance is expanded to include biofuels for aviation, and the scope of the 37th Federal Immission Control Ordinance is expanded to include synthetic aviation fuels and renewable hydrogen for aviation.
Furthermore, the adoption of the amended requirements of Implementing Regulation (EU) 2022/996 regarding the accreditation requirement for certification bodies necessitates further adjustments to the 37th Federal Immission Control Ordinance (37. BImSchV)
