For the purpose of implementing Delegated Regulation (EU) 2023/1640, it lays down the conditions under which the energy content of biofuels of categories A, B and C of products from co-processed biomass is taken into account for the obligations to integrate energy from renewable sources into fuels intended for the transport sector as provided for in Article 7 of the Act of 31 July 2023 laying down product standards for the integration of energy from renewable sources into fossil motor fuels intended for the transport sector and amending the Act of 29 April 1999 on the organisation of the electricity market and amending the Act of 12 April 1965 on the transport of gaseous products and others by means of pipelines.

For control purposes, the draft Royal Decree also lays down the procedure for the reporting and recording of the quantities produced in the energy register by producers of products derived from listed biomass.
The draft also provides for the loss of the accreditation for the biofuel classification A, B or C if the conditions on the basis of which the accreditation was granted are no longer met or if fraud is detected, as well as for the audit engagement carried out by FAPETRO.
Finally, the draft amends the Royal Decree of 14 December 2023 laying down the operating rules for the energy register in the road and rail transport sector in order to limit the transfer of energy units between companies and to prevent intermediaries from placing the units on the market, thereby increasing the price for oil companies and suppliers of gaseous fuels that have to meet targets for the integration of energy from renewable sources.
