Decree on experimentation with games with monetisable digital items

The draft decree is adopted pursuant to Articles 40 and 41 of Law No 2024-449 of 21 May 2024 onsecuring and regulating the digital space, which has authorised, on an experimental basis andfor a period of three years, the operation of online games enabling players of legal age who have agreed to incur a financial outlay, to obtain monetisable digital items through a mechanism involving chance.

In this context, the draft decree sets out the categories and additional rewards authorised within the framework of this experimentation. It also specifies the information that must be previously declared to the regulatory authority, the National Gaming Authority, before any gaming offer is marketed; the procedures for opening, managing and closing players' accounts by the gaming company; the list of data made available to the National Gaming Authority by the companies as well as their format and transmission procedures; and, finally, the procedures by which gaming companies implement mechanisms aimed at preventing excessive or pathological gambling behaviour.
