The Decision covers both service providers offering one or more broadcasting services as available to the public in a linear or non-linear manner, as well as to private broadcasters providing non-linear television services and to video platform service providers.

Decision of the Flemish Government on the promotion of the audiovisual sector through financial contributions to the production of audiovisual works

This decision of the Flemish Government lays down the detailed modalities and conditions for the operationalisation of the incentive scheme, as introduced in the decree amending the Decree of 27 March 2009 on radio broadcasting and television, as regards to the promotion of the audiovisual sector.

Being service distributors offering one or more broadcasting services as available to the public in a linear or non-linear manner, private broadcasters providing non-linear television services and video platform service providers, the investors as defined in the Decree amending the Decree of 27 March 2009, shall participate annually in the production of audiovisual works. On the one hand, such participation may consist of a direct financial contribution, which afterwards can take two different forms. More precisely, it may be a contribution to production projects or a contribution to the acquisitions of broadcasting rights to a production project. On the other hand, the participation may consist of an equivalent financial contribution to the Flemish Audiovisual Fund.
In practice, the decision lays down the conditions and modalities: 1) of the procedure for submitting the production projects; 2) to take into account a contribution to the acquisition of broadcasting rights; 3) with regard to the assessment of the admissibility, recognition and follow-up of production projects and contributions to the acquisition of broadcasting rights; 4) regarding the procedure for the equivalent financial contributions to the Flemish Audiovisual Fund.
