Draft Decision No 76/2022 of the Supreme Chemical Council (SCC) entitled “control measures and sanctions for the implementation of Regulation (EC) No 1907/2006 of the European Parliament and of the Council”
The draft of the new Decision consolidates control measures and sanctions for the implementation of the Regulation into a single text to facilitate all stakeholders, while clarifying the control procedures and modernising the administrative sanctions.
The basic differentiation of the draft of the new Decision from the ones repealed is the formulation and specification of criteria for the imposition of measures and sanctions, thus seeking to scale them up as regards infringing economic operators, in order to respect the principle of proportionality while protecting human health, the environment and any other aspect of public interest.
In addition, it enhances transparency in management’s decisions by avoiding the wide and without criteria range of prices for each infringement.
The provisions of this draft do not entail any expenditure to the detriment of the State budget.
The provisions of this draft have been developed upon consultation with the Chemical Services responsible for the implementation and enforcement of these sanctions.
