The proposal concerns tobacco products.

Draft Order on maximum levels, health warnings and age verification system etc. of tobacco products etc.

Implementation of parts of Commission Delegated Directive (EU) 2022/2100 of 29 June 2022 amending Directive 2014/40/EU of the European Parliament and of the Council as regards the withdrawal of certain exemptions in respect of heated tobacco products.

On the basis of the Directive, Order No 669 of 30 May 2016 on maximum levels, health warnings and age verification system etc. of tobacco products etc. must be revised. With the revision heated tobacco products, insofar as they are tobacco products for smoking, are covered by the provisions on the carrying of the information message laid down in Article 9(2) of the Tobacco Products Directive and the combined health warnings set out in Article 10 of the Tobacco Products Directive. The other elements of the Delegated Directive are implemented in the context of the Bill with notification 2023/45/DK.
In addition to the implementation of the Delegated Directive, three references have been amended in the Order, as there is currently no reference to the intended provisions. This concerns the reference in § 16(1)(1), § 16(1)(2) and § 17(3). Furthermore, §§ 27-31, which relate to transitional periods that are no longer relevant, are repealed.
