This standard aims to establish a basic general framework, applicable throughout Spain, to, through the regulation of a sustainable supply of nutrients to agricultural soils, achieve a reduction in emissions of greenhouse gases and other polluting gases, especially ammonia, preventing pollution of water, both surface and underground, preserving and improving the biological properties of agricultural soils, enhancing their management as ‘living soils’, preventing the accumulation of heavy metals and other contaminants in agricultural soils and preserving the biodiversity linked to agricultural soils.

DRAFT ROYAL DECREE /2022 OF LAYING DOWN STANDARDS FOR SUSTAINABLE NUTRITION IN AGRICULTURAL SOILS

The draft consists of 29 articles, structured in six chapters, two additional provisions, one transitional provision, six final provisions and 12 annexes.

The various chapters of the draft address general objective aspects, definitions, the obligations on farmers when supplying the different materials and the obligations on the suppliers of these materials, in order to facilitate the achievement of the objectives. The reference to the fertilisation consultant and to a registry of operators is explained further. There is also a chapter
dedicated to monitoring and the penalty system.
Technical aspects of the standard are developed in the annexes, such as the content of the fertilisation log (Annex I), prohibition periods for nitrogen fertilisation (Annex II), calculations of the nutrient needs of crops (Annex III), parameters relating to the contents and inputs of heavy metals and other contaminants and impurities (Annex IV), mitigation measures in the application of fertilising products and other materials (Annex V). manure processing deemed to be an intermediate activity for the purposes of Regulation (EC) No 1069/2009 (Annex VI), manure parameters (Annex VII), materials other than fertilising products and manure that can be used (Annex VIII), good practices in the use of irrigation water for fertilisation (Annex IX), General
Register of manufacturers and other economic operators of fertilising products (REGFER) (Annex X), licence to act as a consultant (Annex XI) and analytical methods (Annex XII).
The first final provision amends Annex I to Royal Decree 1310/1990 of 29 October 1990 regulating the use of sewage sludge in the agricultural sector. The second final provision amends Annex III to Royal Decree 1311/2012 of 14 September 2012 establishing a framework of action for achieving the sustainable use of plant protection products, in order to be able to incorporate fertilisation activities into the field logbook. Finally, the third additional provision amends the composition of the Committee of Experts on Fertilisation in order to adapt it to the needs of this text, by amending Order APA/1593/2006 of 19 May 2006 establishing and regulating the Committee of Experts on Fertilisation.
The sixth final provision stipulates that the Royal Decree will enter into force one year after its publication in the Official State Gazette, with the exception of Article 18 (General Register of manufacturers and other economic operators of fertilising products) which will enter into force on 1 January 2026.
