Packaging subject to a deposit obligation in the existing national deposit and return system for certain beverage packaging.

Order on deposits on and collection, etc. of packaging for some beverages

The Order implements minimum administrative requirements for extended producer responsibility schemes for the disposable packaging and refillable packaging that is part of the existing deposit and return system.

These are the minimum requirements:
- obligation to comply with the requirement of 90 % recycling of the waste collected through the deposit and return system (both disposable packaging and refillable packaging)
- handling of information obligations targeted at waste holders to refrain from littering (both disposable packaging and refillable packaging)
- establishment of systems for self-monitoring data on quantities placed on the market, data on waste volumes and financial management (both disposable packaging and refillable packaging)
- obligation to publish information on ownership of collective scheme and on members, fee sizes and selection procedures for the selection of waste treatment companies (for disposable packaging).
- requirement for the environmental modulation of the financial contributions of the producers to cover the operational costs related to the handling of disposable packaging in the collective scheme Dansk Retursystem A/S. The criteria for environmental modulation are laid down by Dansk Retursystem A/S.

In addition, requirements for extended producer responsibility schemes for single-use plastic beverage containers are implemented regarding the costs incurred by producers of collection and waste management of waste from these products discarded in public collection systems and littered in public spaces.

Minor adjustments are also made to reduce administrative burdens:
- increase of the limit on the number of packagings for which so-called flex registration may be used. The limit is raised from 50,000 pieces of packaging per year to 100,000 pieces of packaging per year. Flex registration is used when vendors test new products on the market and allows only one type of packaging to be registered despite, for example, several flavours.
- more flexibility regarding the deadline for payment of invoices to Dansk Retursystem
