Order on the discharge into the sea of substances and materials from offshore oil and gas installations and on monitoring in the sea around the installations

This Order lays down in its entirety rules on the discharge into the sea of substances and materials from oil and gas installations operating on the Danish territorial waters or the Danish continental shelf area, cf. Chapter 1 of the Act on the Protection of the Marine Environment, including on the basis of the decisions and recommendations adopted by the Oslo-Paris Commission under the Convention for the Protection of the Marine Environment in the North East Atlantic (OSPAR Convention).

The Order serves environmental purposes and aims to ensure that Denmark fulfils its obligations under the OSPAR Convention.
Under Danish environmental rules already in force, offshore operators may only discharge substances and materials, including offshore chemicals, into the sea if they, upon application, have obtained a discharge permit from the competent Danish authority. The permits are given on the basis of the Marine Environment Act and the decisions and recommendations adopted under the auspices of the OSPAR Convention.
Additionally, § 7 of the Order provides that the discharge into the sea of chemicals, cf. Annex 2, colour category 1 (black chemicals), is not permitted. It is only the discharge into the sea that is not allowed. Any use that may take place without discharge is not regulated by this provision. The use or discharge of substances without a valid authorisation is punishable.
The chemicals referred to in the provision are those substances and chemicals which are included in the currently applicable LCPA list (List of Chemicals for Priority Action) under the OSPAR Convention.
