Energy carrier as defined in Annex 1 to the draft (coal, lignite, charcoal, coke, briquettes, wood pellets, wood waste, wood shavings, etc.)
Draft Government Decree on registration procedures and other measures related to the export of raw materials and products of strategic importance in terms of Hungary’s energy security
The Draft Government Decree stipulates that the raw material or product specified in Annex 1, which is of strategic importance in terms of Hungary’s energy security may be sold abroad or taken out of the country after registration with the Minister responsible for energy policy (hereinafter: Minister) and acknowledgement of such notification.
If the sale or export of an energy carrier significantly impedes or impairs the supply of raw materials necessary to maintain Hungary’s energy security, jeopardises public supply, or poses a risk to energy security, the Minister shall inform the Minister responsible for supervising state assets of his proposal to exercise the right of pre-emption or purchase. If the Minister responsible for supervising state assets exercises the Hungarian State’s right of pre-emption or purchase, the Minister shall inform the applicant no later than 10 working days from the receipt of notification that the Hungarian State is exercising the right of pre-emption or purchase in respect of the energy carrier specified in the notification. Otherwise, acknowledgement of the notification will be confirmed in writing.
