The notification required for Europe relates to Article 45 of the draft decision.

This brings together the conditions for non-classified electrical appliances and non-classified electricity storage devices.

Decree of the Flemish Government amending the Decree of the Flemish Government of 1 June 1995 laying down general and sectoral provisions on environmental protection, the Decree of the Flemish Government of 12 December 2008 implementing Title XVI of the Decree of 5 April 1995 laying down general provisions on environmental policy, the Flemish Government Decree of 19 November 2010 laying down the Flemish regulations on environmental recognition, the Flemish Government Decree of 19 July 2013 regulating the information, obligation to prevent, contain and remedy environmental damage, the request for measures and the appeal procedure, the Decree of the Flemish Government of 27 November 2015 implementing the Decree

of 25 April 2014 on the environmental permit, the Decree of the Flemish Government of 3 May 2019 amending various decrees on the environment and agriculture.

Article 45 of the annexed Decree replaces Chapter 6.13 of Title II of VLAREM.

This Chapter combines the conditions for non-classified electrical appliances and non-classified electricity storage devices.
Section 6.13.1 defines the scope and lays down common provisions on the application of the Codex on Welfare at Work, the AREI [General Provisions on Electrical Installations], a code of good practice and conditions on noise emissions.
The provisions of section 6.13.2 shall apply to transformers, fixed batteries and fixed charging devices previously included in the classification list (Class 3 devices), but which are removed from the classification list by this amending act, by removing items 12.2.1 and 12.3. The relevant conditions set out in Chapter 5.12 of Title II of VLAREM shall be renamed or moved to this Chapter 6.13. Transformers in closed transformer houses which comply with the technical requirements for the connection of a transformer house, as specified in the requirements of Synergrid C2/112, shall be exempted for the installation of extinguishers. In addition, the provisions of this Section shall also apply to transformers temporarily employed in construction, demolition, or road works. These installations are subject to a threshold of 100 kVA (analogous to the other transformers). These are devices which were non-classified for this amending decision, but for which it is appropriate to take certain preventive and/or mitigating measures to reduce the environmental impact. As these are merely non-classified devices, no upper limit is imposed on the scope. Transformers temporarily used in construction, demolition or road works are subject to the same conditions as for other non-classified transformers.
