Germinal products from kept terrestrial animals, except birds.

Draft regulation supplementing the Animal Health Regulation with rules concerning germinal products from kept terrestrial animals (the Germinal Products Regulation)

The draft Regulation suggests the following technical rules regarding germinal products from bovine and porcine animals intended for reproduction purposes in Norway:

§ 7 National provisions regarding germinal products from bovine and porcine animals intended for reproduction purposes in Norway Operators of germinal product establishments for bovine and porcine animals, from which germinal products of those animals are moved to a Norwegian establishment with bovine og porcine animals for reproduction purposes, shall apply the Norwegian Food Safety for approval of the establishment. The obligation to provide information and the conditions for granting approval are the same as for germinal product establishments that must be approved according to the Animal Health Regulation and Regulation (EU) 2020/686, which is implemented in § 3. The rules regarding cessation of activities and record keeping applicable for approved establishments also applies to these establishments.
The rules regarding identification and traceability of germinal products in Regulation (EU) 2020/686, which is implemented in § 3, applies similarly for germinal products from bovine and animals intended for reproduction purposes in Norway.
The rules regarding movement of germinal products from bovine and porcine animals to other EEA-countries in Regulation (EU) 2020/686 Article 12, Article 15, Article 16, Article 17, Article 18, Article 19, Article 20, Article 21, Article 24, Article 26, Article 28 and Article 29, which is implemented in § 3, applies similarly for movement of germinal products to Norwegian establishments with bovine or porcine animals for reproduction purposes.
The draft Regulation also suggests the following technical rules regarding germinal products from ovine, caprine or equine animals:
§ 10 National provisions regarding movement of germinal products from registered establisments for germinal products from ovine, caprine og equine animals Operators of registered germinal product establishments for ovine, caprine or equine animals may only move consignments of germinal products to Norwegian establishments with ovine, caprine og equine animals for reproduction purposes if the consignment complies with the following conditions:
a. the germinal products were collected from animals which did not show symptoms or clinical signs of transmissible animal diseases on the day of collection.
b. the movement was authorised respectively by the centre or team veterinarian.
§ 11 National provisions regarding donor animals in registered establishments for germinal products from ovine, caprine or equine animals
The centre or team veterinarian for registered establishments for germinal products from ovine, caprine or equine animals shall ensure that the donor animals comply with the following conditions:
a. They are born and kept since birth in Norway, or they have been moved to Norway from EEA-countries in accordance with the movement conditions applicable for movements between EEA-countries, or the have been imported from third countries in accordance with the requirements for importation from third countries.
b. they are identified in accordance with the Terrestrial Animal Traceability Regulation.
The Norwegian Food Safety may lay down further requirements. The requirements may however not be stricter than those applicable to donor animals kept in approved establishments for germinal products from these species.
§ 15 Transitional provisions (second indent)
Germinal products collected, produced, processed or stored in accordance with Regulation 4. July 1989 No 541 on breeding centres, Regulation 31. 1998 No 1477 on animal health conditions for import and export of semen, ova and embryos from certain animal species, Regulation 31. December 1998 No 1486 on animal health conditions for import and export of bovine embryos, Regulation 17 July 2003 No 972 on animal health conditions for production, import, export and use of boar semen or Regulation 6 October 2003 No 1242 on animal health conditions for production, storage, import and export of bull semen, may be moved to Norwegian establishments with terrestrial animals for reproduction purposes.
