Regulation of the Minister for the Interior and Kingdom Relations amending the Environment Arrangement and some other regulations relating to the inclusion of the risk matrix and technical adaptations to the system of the Environment and Planning Act (Omgevingswet) for the subject-matter
This regulation includes changes to the Environment Regulation and some other regulations, all related to building activities. Track changes have been used in the regulation: the crossed-out parts are deleted and the underlined parts are inserted. These parts may contain technical requirements. The regulation contains implementation rules and also aims to guarantee a smooth transition from the existing (construction) law to the law that will apply when the system of the Environment and Planning Act (Omgevingswet) enters into force. In addition, the regulation includes the elaboration of the risk matrix. This is a document used to estimate the risks posed to the environment during construction. The risk matrix is already compulsory under the Living Environment Buildings Decree as part of the permit application or notification for construction or demolition work (notification number 2020/613/NL); this regulation provides only the format of the risk matrix that is submitted for authorisation or notification.
The technical requirements are set out in Article I (B), (C), (D), (E) and (L).
Article 1.3 of the Environmental Regulation also contains a provision for mutual recognition.
