Ordinance amending the Ordinance (2018:1462) on producer responsibility for packaging
The regulations partly implement the requirements of Directive (EU) 2019/904 of the European Parliament and of the Council of 5 June 2019 on the reduction of the impact of certain plastic products on the environment (single-use plastics directive), European Parliament and Council Directive 94/62/EC of 20 December 1994 on packaging and packaging waste (Packaging Directive) and Directive 2008/98/EC of the European Parliament and of the Council of 19 November 2008 on waste and repealing certain Directives (Waste Directive).
A plastic packaging that is a single-use product shall, from 2030, contain at least 30 percent recycled plastic in order to be placed on the Swedish market by a producer.
The requirement shall not apply to the part of a plastic packaging that is in direct contact with food, pharmaceuticals or medical devices. The exemption does not apply to plastic bottles for beverages. Nor does the requirement apply to plastic bottles for beverages intended, and used, for food for special medical purposes.
The recycled content shall be calculated as an average of the packaging that is placed on the Swedish market by a producer during a calendar year.
A producer who places a beverage bottle or other plastic packaging on the Swedish market shall submit information to the Swedish Environmental Protection Agency no later than 31 March each year about how much recycled plastic has been used in the beverage bottles and plastic packaging during the previous calendar year. The Swedish Environmental Protection Agency shall notify regulations about the information that is to be provided.
The Swedish Environmental Protection Agency shall issue regulations on exemptions from the requirement for recycled content regarding plastic packaging for which there are special reasons for placement on the Swedish market.
The requirements shall enter into force on 1 January 2030.
