Wine-growing material.

Draft ordinance establishing the official register of polyclonal wine-growing materials, hot water immersion treatment of vine propagation materials and insect-proof facilities for the production, control and certification of polyclonal material

Decree-Law No 194/2006 of 27 September, as amended by Decree-Laws No 78/2020 of 29 September and 9/2021 of 29 January, which regulates the production, control, certification and marketing of vegetative propagating material of vines, stipulates in Article 42a that procedures and requirements for hot water treatment of wine-growing materials may be laid down by means of an ordinance issued by the member of the Government responsible for agriculture, for the purpose of regulating the official recognition of insect-proof facilities for the production, control and certification of polyclonal and other materials which are to be regulated in accordance with the Decree-Law.

Firstly, the procedures for the official recognition of voluntary certification of polyclonal vine propagating material are to be established. This certification, however, shall not conflict with the compulsory certification for the marketing of wine-growing materials, as regulated by Decree-Law No 194/2006, as it stands.
Polyclonal vine propagation materials are obtained through an innovative breeding technique developed in Portugal and internationally recognised by the Office International de la Vigne et du Vin (OIV), through resolution OIV-VITI 564B-2019, which establishes the OIV process for the recovery and conservation of the intravarietal diversity and the polyclonal selection of the vine in grape varieties with wide genetic variability.
Secondly, taking into account the recent amendments to phytosanitary legislation, as provided for in Article 27 of Decree-Law No 194/2006 of 27 September, in particular by additional Commission Implementing Regulation (EU) 2019/2072 of 28 November 2019, establishing uniform conditions for the implementation of Regulation (EU) 2016/2031 of the European Parliament and the Council, as regards protective measures against pests of
plants, and the amendments introduced by above-mentioned Decree-Law No 78/2020 of 29 September, the use of hot water immersion treatment of vine propagation material as a phytosanitary measure applicable in the control of quarantine organisms is reinforced. This is why it is equally opportune to establish the technical requirements and procedures that regulate this measure.
Thirdly, technical requirements and procedures for the approval, construction and maintenance of insect-proof shelters are laid down; a phytosanitary measure which is also reinforced by the provisions of the legislation referred to in the previous paragraph.
