Packaging and packaging waste

Decree of (indicate the date) amending the 2014 Packaging Management Decree related to the implementation of the Directive (EU) 2018/852 of the European Parliament and of the Council of the 30 May 2018 amending the Directive 94/62/EC on the packaging and packaging waste and the application of general rules concerning extended producer responsibility regimes as from 1 January 2023

Article I, parts C and D may contain technical regulations.

As part of the implementation of the Directive (EU) 2018/851, the decree sets circular objectives and new recycling objectives.
The circular objectives set out in the article I, part C, and the recycling objectives set out in article I, part D, all concern minimum standards for which the producer or importer is the standard addressee. Because reusing prevents the generation of packaging waste, both standards have a different scope. The circular objective concerns the total quantity of reused packaging and recycled packaging material compared to the total weight of packaging material used for the inclusion, the protection, the loading, the delivery, or the presentation of products placed on the market.
The recycling objective concerns the proportion of recycled packaging waste compared to the total amount of packaging waste.
A provision of mutual recognition is not necessary because the obligations contained in the decree do not result in the non-admission of foreign products.
