Draft Decree of the Council of Ministers on the adoption of a Regulation on the general mandatory gaming conditions and rules for gambling with a licence

Currently the matter governed by the draft is regulated by General mandatory conditions and rules for organising casino gambling, adopted by the State Commission on Gambling to the Ministry of Finance, published in the State Gazette (SG) No 87 of 2016, General gaming conditions and rules for organising gambling with slot machines, adopted by the State Commission on Gambling to the Ministry of Finance, published in the State Gazette (SG) No 32 of 2014, General gaming conditions and rules for organising lottery games, adopted by the State Commission on Gambling to the Ministry of Finance, published in the State Gazette (SG) No 22 of 2017, General gaming conditions and rules for organising games with betting on random events and betting related to the knowledge of facts, adopted by the State Commission on Gambling to the Ministry of Finance, published in the State Gazette (SG) No 22 of 2017, and General gaming conditions and rules for organising games with sports betting and with betting on horse and dog races, adopted by the State Commission on Gambling to the Ministry of Finance, published in the State Gazette (SG) No 22 of 2017. The aforementioned acts have been issued on the basis of the Gambling Act, in its version prior to the amendments published in the State Gazette (SG) No 69 of 2020. According to the intended amendments, these public relations will be governed by a regulation of the Council of Ministers, adopted at the proposal of the Minister for Finance pursuant to Article 17(3)(1) of the Gambling Act (GA).
The Regulation regulates the general mandatory gaming conditions and rules for organising gambling with slot machines in amusement arcades; gambling in gaming casinos; games with sports betting and with betting on horse and dog races; games with betting on random events and betting related to the knowledge of facts; lottery games in the meaning of Article 48 GA.
The draft Regulation lays down specific conditions that must be fulfilled in order to organise the respective game for which a licence has been granted under the GA, as well as the rules for organising the respective game. The adoption of the Regulation will lead to the creation of a regulatory framework on:
- alignment with the latest amendments to the Gambling Act of the general mandatory gaming conditions and rules for gambling with a licence;
- creation of legal certainty for individuals by exhaustive regulation of the relevant rules and conditions for conducting the games;
- explicitly defined, and in a manner that is clear for gambling organisers and players, conditions and rules for gambling with a licence;
- the requirements that gambling organisers must fulfil in the drafting of the relevant rules that are submitted for approval to the Executive Director of the National Revenue Agency pursuant to Article 17(1)(4) GA;
- implementation of effective control activity by the regulator by creating a regulatory framework on the conditions and the rules with which gambling with a licence must comply.
Pursuant to the provision of Article 26(3) of the Legal Acts Act, the draft act provides for public consultations.
The draft Decree of the Council of Ministers, the draft Regulation, the report thereto, the partial preliminary impact assessment and the opinion of Directorate - “Modernisation of the Administration”, which is part of the administration of the Council of Ministers, have been published on the website of the Ministry of Finance and on the Public Consultation Portal for a period of 30 days.
