Marking of alcohol on consumer packaging

Implementing Decree amending certain implementing decrees in the remit of the authorities of the Customs Administration of the Czech Republic

In accordance with Directive 2015/1535/EU, we are notifying the entire draft legislation, i.e. the draft Implementing Decree amending certain implementing decrees in the remit of the authorities of the Customs Administration of the Czech Republic; however, the Ministry of Finance of the Czech Republic considers only Division 2, Article III of the draft to be a technical regulation.

The amendment of Implementing Decree No 334/2013 on the implementation of certain provisions of the Act on the compulsory marking of alcohol is related to statutory authorisation by virtue of § 75 of draft Act No 307/2013 on the compulsory marking of alcohol.

Due to amendments to the Act on the compulsory marking of alcohol, the Implementing Decree will regulate the following issues:

• within the scope of the records of control strips, even damaged control strips will be tracked;

• the sales price of a control strip will increase;

• orders for control strips will now specify the location where the alcohol will be marked;

• there will be a formal amendment in terms of forms for the registration of entities obliged to mark alcohol and alcohol distributors: these forms will now be legislated in the Implementing
Decree instead of merely being issued by the Ministry of Finance, as is the case now.
