Tobacco and tobacco related products, devices intended to aid in the consumption of such products

Draft Law of the Republic of Lithuania amending Articles 2, 17 and 26 of and inserting Article 15(1) to Law No I-1143 on the control of tobacco, tobacco products and other related products (Law No XIIIP-3603(3))

Specialised requirements for retail outlets

1. It is prohibited to publicly display or show tobacco products and related* products, and devices intended to aid in the consumption of such products, at retail outlets.

*Products related to tobacco products are electronic cigarettes, electronic cigarette refill containers, and herbal products for smoking.

2. The prohibition laid down in paragraph 1 does not apply in respect of tobacco products and related products and devices intended to aid in the consumption of such products sold at tobacconists* and tobacco sections** (provided that the products and/or devices are not displayed or shown in the external windows, or through other external equipment, of such tobacconists or sections), retail outlets at international sea ports or airports or at border crossing points between the Republic of Lithuania and third countries, where goods are sold only to passengers departing from the Republic of Lithuania, as well as on board ships, aircraft and trains carrying passengers on international routes.

*‘Tobacconist’ means a shop whose offering of goods consists entirely of tobacco products and related products, devices intended to aid in the consumption of such products, goods and their parts intended to aid in preparation for smoking, as well as paraphernalia pertaining to smoking.

**‘Tobacco section’ means a shop section whose offering of goods consists entirely of tobacco products and related products, devices intended to aid in the consumption of such products, goods and their parts intended to aid in preparation for smoking, as well as paraphernalia pertaining to smoking.

3. Only the following information pertaining to tobacco products and related products may be displayed at retail outlets while adhering to the provisions laid down by the body authorised by the Government of the Republic of Lithuania:

1) names of producers, of tobacco products and related products, and of devices intended to aid in the consumption of such products;

2) the words ‘We carry’ and ‘We sell’;

3) the prices of unit packets and of outside packaging containing several unit packets of tobacco products and related products, and of devices intended to aid in the consumption of such products.

4. In addition to the information authorised for presentation in paragraph 3, the display or showing of tobacco products and related products, and of devices intended to aid in the consumption of such products, is permitted at tobacconists and tobacco sections (provided that the products and/or devices are not displayed or shown in the external windows or through other external equipment of such tobacconists or sections).

5. Retail outlets, while adhering to the provisions laid down by the body authorised by the Government of the Republic of Lithuania, must also display information (warnings) about the harmful health effects of the use of tobacco products and about the prohibition against the sale of tobacco products to individuals under 18 years of age (this provision is not being amended, but is provided due to a subsequent reference to it).

6. The information specified in paragraph 3 is only to be authorised for presentation at locations where tobacco products and related products, and devices intended to aid in the consumption of such products, are sold. It may not be presented in booklets, flyers or other means of advertisement intended for consumers to carry away. It is furthermore to be prohibited to display imitations or images of tobacco products and related products, or their unit packets, and of devices intended to aid in the consumption of such products, at retail outlets. Other than what is provided in paragraphs 3 and 5, no visual or graphic information about tobacco products and related products, and devices intended to aid in the consumption of such products, may be presented at retail outlets.

The date of entry into force will be decided by the Seimas (Lithuanian Parliament) of the Republic of Lithuania subsequent to this notification of the draft Law.
