Order amending the Building Decree 2012 and the Environmental Structures Decree with regard to the improvement of construction safety as well as of safety and health in structures and certain other amendments

The Building Decree 2012 contains regulations on the renovation and demolition of structures, the condition and use of existing structures, open areas and grounds, and safety during construction and demolition works. This amending order includes various amendments to the Building Decree 2012 that improve construction safety as well as safety and health in structures. All amendments are also included in the Environmental Structures Decree, the decree that will replace the Building Decree 2012 as part of the system of the Environment Act. This amending order includes, amongst other things, the adjustment of the fire and smoke classes for electrical cables and pipe insulation resulting from the new standardisation standard based on Commission Delegated Regulation (EU) 2016/364 of 1 July 2015 on the classification of the reaction to fire performance of construction products pursuant to Regulation (EU) No 305/2011 of the European Parliament and of the Council.

Article 1(3) of the Building Decree 2012 contains an equivalence provision that also applies to this amendment. See also the explanatory notes by article regarding said provision.

Article 1(3) of the Building Decree 2012:

1 A regulation laid down in Chapters 2–7 need not be met or applied if the structure or use thereof offers at least an equivalent level of safety, health protection, usability, energy efficiency and
environmental protection as intended in the regulations stated in these chapters.

2 An equivalent solution, as referred to in point 1, shall be maintained during use of the structure.
