This affects combustion plants within the meaning of Directive (EU) 2015/2193 (‘MCP Directive’) with a fuel thermal input equal to or greater than 1 and less than 50 megawatts (MW) in the federal province of Upper Austria, insofar as they are subject to provincial law in accordance with the federal distribution of powers.

This Ordinance mainly serves to transpose the emission limit values of Directive (EU) 2015/2193 (‘MCP Directive’). In order to ensure a uniform regulation at provincial level, reference is made to the transposition of the Directive already carried out in the Combustion Plants Ordinance 2019 (FAV 2019), Federal Law Gazette II No 293/2019. This creates a uniform regulation within the constitutional competences of the federal government and the provinces for combustion plants subject to the MCP Directive.
