Decree on the prohibition of certain single-use plastic products

The draft decree defines the conditions for application of the legislative provisions of the Environmental Code intended to prohibit the provision of certain single-use plastic products from 1 January 2020 onwards.

In this respect it specifies the conditions for application of Article L541-10-5(III) of the Environmental Code, introduced by Article 73 of Law 2015-992 of 17 August 2015 on energy transition for green growth and amended by Article 28 of Act No 2018-938 of 30 October 2018 to balance trade relationships in the agricultural and food sector and provide food which is healthy, sustainable and accessible to all.

The draft decree provides the definitions and characteristics of single-use plastic products covered by the prohibitions on provision. The prohibitions will come into force gradually; in 2020 for some products, in 2021 for others, in accordance with Directive 2019/904 of the European Parliament and of the Council on the reduction of the impact of certain plastic products on the environment.
