Draft Regulation of the Minister for Investment and Development amending the Regulation on the method of drawing up a declaration of performance for construction products and applying a construction mark thereon

This Regulation revises the existing Regulation of the Minister for Infrastructure and Construction of 17 November 2016 on the method of drawing up a declaration of performance for construction products and applying a construction mark thereon (Journal of Laws [Dziennik Ustaw] 2016, item 1966 and 2018, item 1233).

Amendments under § 4 of the Regulation which implement ‘an assessment of the performance of construction products on the basis of tests on sample’ will make it possible to carry out the performance assessment process set out in national systems for assessing and verifying the constancy of performance of construction products without the need for a certification body (national system 1+ and 1) or producer (national system 2+) to collect samples each time.

It should be pointed out that the assessment and verification performed by the certification body (system 1+ and 1) and the producer (system 2+) invariably include the assessment of the performance of the construction product based on the testing of samples. The amendment allows the certification body to use samples for testing which it has not collected, but responsibility for the entire assessment and verification process performed by the certification body remains unchanged and rests with the body in question.

In addition, clarification has been provided on the applicability, as a national technical specification, of a Polish Product Standard having the status of a withdrawn standard, i.e. application for a period of one year from the date of withdrawal or the date indicated in the preface of the replacement standard as the date of withdrawal of national standards which conflict with a given standard, if this period is longer than one year.
