Solid-fuel boilers with a rated thermal power of no more than 500 kW

Draft Act amending the Environmental Protection Act and the Trade Inspection Act

The reinforcement of the monitoring and control system for solid-fuel boilers with a rated thermal power of no more than 500 kW placed on the market, used to heat small buildings, small and medium-sized manufacturing and service establishments. The requirements for boilers are set out in a national regulation. The new regulations will allow for a reduction in the number of boilers placed on the market which do not meet the emission standards set out in the above-mentioned provisions. The most significant changes proposed:

– Imposing a statutory obligation on the bodies of the Trade Inspectorate and granting them the corresponding competence to carry out inspections verifying whether the entities which place solid-fuel boilers with a rated thermal power of no more than 500 kW on the market fulfil the provisions of the above-mentioned regulation with regard to the requirements for solid-fuel boilers;

– Granting regional inspectors of the Trade Inspectorate the right to impose financial administrative sanctions for failure to comply with the provisions of the above-mentioned regulation with regard to the requirements for solid-fuel boilers (no more than 5 % of the entrepreneur’s revenue; minimum fine: PLN 10,000);

– The possibility to introduce restrictions on the placing on the Polish market of solid-fuel boilers which do not meet the requirements by operators from other EU countries, Turkey and EFTA countries which are a party to the Agreement on the European Economic Area.
