Article 1: additions to the substance groups for new psychoactive substances (NPS) as defined in § 2(1) of the New Psychoactive Substances Act [Neue-psychoaktive-Stoffe-Gesetz, NpSG], i.e. substances or preparations of substances from one of the following substance groups: compounds derived from 2-phenethylamine, cannabimimetics/synthetic cannabinoids, benzodiazepines, compounds derived from N-(2-aminocyclohexyl)amide and compounds derived from tryptamine.

Article 2: inclusion of the following in Annex II to the Narcotics Act [Betäubungsmittelgesetz, BtMG]:

CUMYL-4CN-BINACA (SGT-78),

Cyclopropylfentanyl,

5F-CUMYL-PEGACLONE (Cumyl-5F-PeGaClone, 5F-SGT-151),

4-Fluoroisobutyrylfentanyl (4-fluoroisobutyrylfentanyl, 4F-iBF, p-FIBF),

Methoxyacetylfentanyl,

Ocfentanil (A-3217),

Tetrahydrofuranylfentanyl (THF-F),

U-48800.

Draft Ordinance amending the Annex to the New Psychoactive Substances Act and Annexes to the Narcotics Act

It is the intention of the Federal Republic of Germany to bring further NPS within the scope of both the BtMG and the substance groups in the NpSG.

The existing substance groups of compounds derived from 2-phenethylamine and cannabimimetics/synthetic cannabinoids in the NpSG Annex shall be revised, and the substance groups of benzodiazepines, compounds derived from N-(2-aminocyclohexyl)amide and compounds derived from tryptamine shall be added.

Two synthetic cannabinoids and six synthetic opioids are added to Annex II (marketable narcotics not available on prescription) to the BtMG.

In addition, two common street names are added to the description of one particular substance in Annex I BtMG to increase the legal certainty when categorising this substance. This provision does not require notification.
