Draft Act amending the Fertiliser and Fertilisation Act

The draft envisages the introduction of a new category of fertiliser products, i.e. digestates which will be placed on the market as a separate group of products. Before the change, the digestates were placed on the market as organic fertilisers, on the basis of the permit issued by the Minister for Agriculture and Rural Development. The draft also includes provisions facilitating the placing on the market of processed natural fertilisers, for example processed through granulation or drying - without the need to apply for a permit from the Minister for Agriculture and Rural Development. The draft assumes that applicants requesting a permit to place fertilisers or plant growth promoters on the market for which names containing the words 'bio' or 'eco' have been defined or which indicate in other ways that the fertiliser or plant growth promoter is intended for use in organic farming, together with the application for a permit will be required to submit additionally the opinion of the authorised organisational unit confirming the suitability of a given fertiliser or plant growth promoter for organic production. The draft imposes on entities the obligation to submit to the Regional Inspectors for Agricultural and Food Quality the intention to place fertilisers, plant growth promoters and digestates on the market (excluding entities which place their products on the market on the basis of permits issued by the Minister for Agriculture). The draft imposes on the Chief Inspector for Agricultural and Food Quality the obligation to maintain an online list of fertilisers or plant growth promoters or digestates placed on the market and to keep a list of fertilisers placed on the market bearing EC FERTILISER marking. The draft specifies the provisions on the supervision and control of the marketing of fertilisers, plant growth promoters and digestates. The draft introduces changes in the labelling of packaging, labels and documents in which fertilisers, plant growth promoters and digestates are supplied.
