The draft Regulation aims to increase the quantity for the direct supply of small quantities of raw sheep or goat’s milk, performed by a producer, by increasing the number of animals on a farm.

Regulation amending Regulation No 26 of 2010 on specific requirements for the direct supply of small quantities of raw materials and foods of animal origin

Regulation No 26 of 2010 on the specific requirements for the direct supply of small quantities of raw materials and foods of animal origin sets out the conditions and procedure for:

1. the direct supply performed by the producer to the final consumer or to local retail establishments which directly supply final consumers with small quantities of:

a) primary products - raw milk, honey and bee products, hen and quail eggs, and fresh and chilled sea and freshwater fish;

b) fresh meat from poultry and rabbits slaughtered on the farm;

c) shot large and small game or meat from large and small game;

2. the supply of foods of animal origin, treated and/or processed in a retail establishment, to other retail establishments as a marginal, localised and restricted activity;

3. the registration of persons performing direct supplies under subparagraph 1 and the registration of retail establishments from which the food supply under subparagraph 2.

Pursuant to Article 1(4), in conjunction with paragraph 3(c), of Regulation (EC) No 853/2004 of the European Parliament and of the Council of 29 April 2004 laying down specific hygiene rules for food of animal origin, Member States shall establish, in accordance with their national legislation, rules regulating the activities and persons directly supplying small quantities of primary products. Such national rules must ensure that the objectives of the Regulation will be achieved.

Furthermore, Regulation No 26 of 2010 introduces the conditions and procedure for the supply of food of animal origin, treated and/or processed at a retail establishment, to other retail establishments as a marginal, localised and restricted activity in accordance with Article 1(5)(b)(ii) of Regulation (EC) No 853/2004. According to the provisions of Regulation (EC) No 853/2004, Member States should have some discretion to extend or to limit the application of the requirements of the Regulation to retail under national law. However, they may limit their application only if they consider that the requirements of Regulation (EC) No 852/2004 are sufficient to achieve food hygiene objectives and when the supply of food of animal origin from a retail establishment to another establishment is a marginal, localised and restricted activity. Such supply should therefore be only a small part of the establishment's business; the establishments supplied should be situated in its immediate vicinity; and the supply should concern only certain types of products or establishments.

Regulation No 26 of 2010 does not provide for a territorial restriction for direct supplies of honey and game meat.

The draft Regulation aims to increase the quantity for the direct supply of small quantities of raw sheep or goat’s milk, which is performed by a producer, by increasing the number of animals on a farm, namely:

Direct supply of small quantities of raw sheep, goat or buffalo cow’s milk is the supply performed by a producer, which does not exceed:

1. 60 % of the monthly milk yield - from farms producing sheep or goat’s milk up to 200 animals during a lactation period, or buffalo cow’s milk up to 50 animals during a lactation period;

2. 50 % of the monthly milk yield - from farms producing sheep or goat’s milk from 200 to 500 animals during a lactation period, or buffalo cow’s milk from 50 to 100 animals during a lactation period;

3. 40 % of the monthly milk yield - from farms producing sheep or goat’s milk above 500 animals during a lactation period, or buffalo cow’s milk above 100 animals during a lactation period.

The draft stipulates that retail establishments may be located in the same and/or in an administrative area which is adjacent to the one where the farm is registered.

The territorial restriction for the supply of dairy products from sheep and goat’s milk is repealed. Specifically, food produced at retail establishments may be supplied to other retail establishments or mobile refrigerated display cabinets which are located:

1. in the same and/or in an adjacent administrative area;

2. on the territory of the whole country for dairy products from sheep, goat and buffalo cow’ s milk.
